Terms of use

The terms for using the Krodium browser and krodium.com.

1. About these terms

These terms are an agreement between you and Svayam Incarnation Limited, a company registered in England and Wales ("we", "us"). They apply when you download or use the Krodium browser ("Krodium") or use krodium.com and our related online services (together, "the services"). By using the services you agree to these terms. If you do not agree, please do not use them.

Other terms also apply in some cases: the Acceptable use policy (krodium.com/acceptable-use) always; the Krodium Store terms (krodium.com/store-terms) when you use the Store; and the Developer Agreement (krodium.com/developers/agreement) if you publish in the Store. Our Privacy policy (krodium.com/privacy) explains how we handle personal data.

If you use Krodium for an organisation, you confirm that you may accept these terms for it.

2. Your licence to use Krodium

Krodium is free. Subject to these terms, we give you a personal, worldwide, non-exclusive, non-transferable and revocable licence to download, install and use Krodium on devices you own or control, for any lawful personal or business purpose.

Much of Krodium is open-source software. Each open-source component is licensed to you under its own licence, listed on the Open-source licences page (krodium.com/licences). Nothing in these terms limits the rights those licences give you. Where these terms and an open-source licence conflict for that component, the open-source licence applies.

Except as open-source licences allow, you may not sell, rent or sublicense Krodium, remove or change our notices, or distribute a modified version that uses the Krodium name or branding.

3. Updates

We publish new versions of Krodium with fixes and improvements, and describe them in the release notes. Some versions may change or remove features. Please keep Krodium up to date: older versions may have known security problems, and we support only the latest version.

4. Early software

Krodium is a young product. Some features are marked as coming, and may change or never arrive. We work hard to make Krodium reliable and secure, but it may have faults. Keep copies of anything important.

5. The web and other services

Krodium is a tool for reaching websites and services run by other people. We do not control, check or endorse them, and we are not responsible for their content, their availability, or how they use your data. Their own terms and policies apply.

You are responsible for what you do with Krodium and for keeping your device, passwords and data safe.

6. Accounts

You do not need an account to use Krodium. Some online services, such as the developer platform, need you to sign in with a Viremail account. Viremail's own terms apply to that account. You are responsible for activity under your sign-in and must tell us at once at [email protected] if you think someone else has used it.

7. Our brand

Krodium, Kraken, the Krodium icon, the Kro mascot and our other names and logos belong to us and are not covered by open-source licences. You may use our name to refer to Krodium accurately, link to our site and use the press kit (krodium.com/press) for writing about Krodium. You may not use our brand in a way that suggests we made, endorse or sponsor something we did not, or in a product name or domain.

Other product and company names belong to their owners. Mentioning them does not mean they endorse us or that we endorse them.

8. The website

We may change, suspend or withdraw any part of krodium.com at any time. We take care to keep it accurate, but content on it is for general information and may be out of date.

9. Ending your use

You can stop using Krodium at any time by uninstalling it. We may suspend or end your access to our online services if you seriously or repeatedly break these terms, or if the law requires it. Sections 2, 7, 10, 11 and 13 continue after your use ends.

10. Our responsibility to you

If you are a consumer, you have legal rights in relation to digital content that is faulty or not as described, including under the Consumer Rights Act 2015. Nothing in these terms affects those rights. Advice about your legal rights is available from Citizens Advice.

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited by law.

Subject to that, Krodium is free and is provided "as is" and "as available". To the extent the law allows, we do not promise that it will be uninterrupted, error-free or suitable for a particular purpose.

If you are a consumer, we are responsible for loss you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care, but not for loss that was not foreseeable, and we are not liable for loss of business, profit or opportunity. If digital content we supply damages a device or other digital content belonging to you because we did not use reasonable care and skill, we will either repair the damage or pay you compensation. We are not liable for damage you could have avoided by installing an update we offered, or by following our installation instructions.

If you use Krodium for business, we are not liable for indirect or consequential loss, or for loss of profit, revenue, data, business or goodwill, and our total liability arising from Krodium in any 12 months is limited to 100 pounds.

11. Law and courts

These terms are governed by the law of England and Wales. Disputes go to the courts of England and Wales. If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings there, and if you live in the European Union, you keep the protection of the mandatory laws of the country where you live and may bring proceedings there.

12. Changes to these terms

We may update these terms, for example to reflect new features or changes in the law. The date at the top shows the latest version. If a change is significant, we will give reasonable notice on this page and, where it affects the browser, in the release notes. If you keep using the services after a change takes effect, the new terms apply. If you do not agree, stop using the services.

13. General

If a court finds part of these terms unenforceable, the rest stays in force. If we do not enforce a right straight away, we can still do so later. Only you and we have rights under these terms. We may transfer our rights and duties to another organisation that will continue to provide Krodium; we will tell you if this affects you.
